These Terms of Service ("Terms") govern your use of allamericanstairlifts.com and all services provided by Infosys Consulting LLC, doing business as All American Stairlifts ("AAS," "we," "us," or "our"). By using our website, submitting a lead form, requesting a quote, or purchasing a stairlift through us, you agree to these Terms.

Please read these Terms carefully. They include important provisions about limitation of liability, dispute resolution, and the nature of our services.

1. What We Do

All American Stairlifts is a stairlift coordination service. We help homeowners select, purchase, and arrange installation of residential stairlifts manufactured by brands including Bruno, Handicare (Savaria), Stannah, and Harmar.

What we do:

  • Provide guidance on stairlift types, brands, and configurations.
  • Coordinate in-home staircase assessments.
  • Generate quotes based on staircase specifications and product selection.
  • Arrange installation through our network of licensed, insured independent contractors.
  • Facilitate manufacturer warranty registration and claims.
  • Assist with funding applications (VA grants, Medicaid waivers, state programs).

What we do not do:

  • Manufacture stairlifts or stairlift components.
  • Employ the installers who perform work in your home.
  • Provide medical advice or mobility assessments.
  • Guarantee specific health outcomes from stairlift use.

2. Independent Contractor Relationship

All installation, assessment, and service work performed in your home is carried out by independent contractors, not AAS employees. Each installer in our network:

  • Holds a valid state contractor license appropriate for stairlift installation.
  • Carries a minimum of $2,000,000 in general liability insurance.
  • Maintains workers' compensation coverage (or valid sole proprietor exemption).
  • Has been vetted by AAS, including background check verification.
  • Is certified by at least one stairlift manufacturer.

While we vet our installers and require these qualifications, each installer is an independent business. AAS does not control the manner, method, or means of their work. The installer is responsible for the physical installation, and their liability insurance covers their work on your property.

3. Quotes and Pricing

All quotes provided by AAS are estimates based on information available at the time of the quote. Prices may change if:

  • The actual staircase measurements differ from the information provided in the initial inquiry.
  • Additional electrical work is required (e.g., installing a dedicated outlet).
  • The staircase structure requires reinforcement or modification.
  • You change the product selection after a quote has been issued.
  • Manufacturer pricing changes between quote date and order date.

Quotes are valid for 30 days from the date of issue unless otherwise stated. A quote becomes a binding agreement only when you sign a purchase agreement and submit the required deposit.

4. Payment Terms

Payment structure varies by project and is detailed in your individual purchase agreement. Standard terms are:

  • Deposit: A deposit is required to confirm your order and schedule installation. Deposit amounts vary by product type (straight vs. curved) and are specified in your purchase agreement.
  • Balance: The remaining balance is due upon completion of installation, after the installer has demonstrated the stairlift is fully operational and you have received training on its use.
  • Financing: We offer financing options through third-party lenders. Financing terms, rates, and eligibility are determined by the lender, not by AAS. Financing is subject to credit approval.

We accept major credit cards, ACH transfers, checks, and wire transfers. All prices are quoted in U.S. dollars.

5. Warranty

AAS does not manufacture stairlifts and does not provide a manufacturer's warranty. All product warranties are provided by the stairlift manufacturer and are subject to the manufacturer's terms and conditions. We facilitate warranty registration on your behalf at the time of installation.

Typical manufacturer warranty periods:

  • Bruno: 5-year limited warranty on major components.
  • Handicare (Savaria): 5-year limited warranty.
  • Stannah: 5-year warranty on motor and gearbox, 2 years on other components.
  • Harmar: 3-year limited warranty.

AAS Workmanship Guarantee: We provide a 30-day workmanship guarantee on the installation itself. If an installation defect becomes apparent within 30 days of completion, we will dispatch an installer to correct the issue at no additional charge. This guarantee covers the quality of the installation work, not the stairlift equipment.

6. Cancellation and Refund Policy

Before Installation

You may cancel your order at any time before installation begins. If you cancel:

  • Before the product has been ordered from the manufacturer: Full refund of your deposit, minus any assessment fee if an in-home assessment was performed.
  • After the product has been ordered but before installation: Refund of your deposit minus restocking fees charged by the manufacturer and any non-recoverable costs (shipping, custom fabrication).
  • Custom curved rail systems: Once a curved rail has entered fabrication (typically 5-7 business days after staircase measurements are finalized), the custom rail portion is non-refundable because curved rails are manufactured to the exact geometry of your specific staircase and cannot be reused.

After Installation

After installation is complete, returns and refunds are governed by the manufacturer's return policy. Most manufacturers do not accept returns of installed equipment. If you experience a product defect, it is covered under the manufacturer's warranty. If you experience an installation defect, it is covered under our 30-day workmanship guarantee.

7. Your Responsibilities

By engaging our services, you agree to:

  • Provide accurate information about your staircase, home, and the intended stairlift user's needs.
  • Ensure the installer has safe, clear access to the staircase and work area on installation day.
  • Secure any pets during the installation.
  • Disclose any known structural issues with your staircase or home (termite damage, rotted wood, loose railings).
  • Ensure adequate electrical service is available or arrange for electrical work before the installation date.
  • Be present (or have an authorized adult representative present) during the installation and training.
  • Read the stairlift owner's manual and follow all manufacturer operating instructions.
  • Not modify, alter, or attempt to repair the stairlift yourself or through an unauthorized service provider, as doing so voids the manufacturer warranty.

8. Limitation of Liability

To the maximum extent permitted by law:

  • AAS's total liability for any claim arising from or related to our services is limited to the amount you paid to AAS for the specific service or product that is the subject of the claim.
  • AAS is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, property damage not caused by our direct actions, personal injury not caused by our direct negligence, or emotional distress.
  • AAS is not liable for the acts, omissions, or negligence of independent installation contractors, except to the extent that AAS failed to exercise reasonable care in vetting the contractor.
  • AAS is not liable for defects in stairlift equipment manufactured by third parties. Equipment defects are governed by the manufacturer's warranty.
  • AAS is not liable for delays caused by manufacturer backorders, shipping carriers, permit processes, or events beyond our reasonable control.

Nothing in these Terms limits liability for fraud, gross negligence, or willful misconduct by AAS, or any liability that cannot be excluded by applicable law.

9. Indemnification

You agree to indemnify and hold harmless AAS, its officers, directors, members, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from: (a) your breach of these Terms; (b) your misuse of the stairlift contrary to manufacturer instructions; (c) your provision of inaccurate information that leads to improper equipment selection or installation; or (d) your unauthorized modification of installed equipment.

10. Dispute Resolution

If informal resolution fails:

  • Governing law: These Terms are governed by the laws of the State of Wyoming, without regard to conflict of law principles.
  • Jurisdiction: Any legal action arising from these Terms or our services shall be brought exclusively in the state or federal courts located in Sheridan County, Wyoming.
  • Mediation: Before filing any lawsuit, both parties agree to attempt resolution through mediation administered by a mutually agreed-upon mediator in Sheridan, Wyoming, or remotely. Each party bears its own mediation costs.
  • Limitation period: Any claim related to our services must be filed within one (1) year of the event giving rise to the claim.

11. Website Use

When using our website, you agree not to:

  • Use automated tools (bots, scrapers) to extract content or data without written permission.
  • Submit false or misleading information through our forms.
  • Attempt to gain unauthorized access to our systems.
  • Use our website for any unlawful purpose.
  • Reproduce, distribute, or create derivative works from our content without permission.

We reserve the right to block access to our website for any user who violates these terms.

12. Intellectual Property

All original content on allamericanstairlifts.com, including text, graphics, logos, page layouts, and software, is owned by Infosys Consulting LLC or used under license. Product images, specifications, and brand logos are the property of their respective manufacturers and are used with permission for product representation purposes.

The "All American Stairlifts" name and associated branding are trademarks of Infosys Consulting LLC. You may not use our trademarks without written permission.

13. Advertising and FTC Compliance

In compliance with Section 5 of the Federal Trade Commission Act, all claims made on our website about products, pricing, and services are truthful and substantiated. Customer testimonials represent genuine customer experiences. Ratings and reviews displayed on our city pages reflect verified customer feedback. Where manufacturer specifications are cited, we rely on published data from the respective brands.

14. Force Majeure

AAS is not liable for delays or failures in performance caused by events beyond our reasonable control, including natural disasters, pandemics, government orders, manufacturer shutdowns, supply chain disruptions, labor strikes, or utility failures. If a force majeure event delays your installation by more than 60 days, you may cancel your order for a full refund of amounts paid.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

16. Changes to These Terms

We may update these Terms from time to time. We will post the revised Terms on this page with an updated "Last Updated" date. For material changes, we will provide notice through our website or by email to customers with active orders. Your continued use of our services after changes are posted constitutes acceptance of the updated Terms.
